The Agreement

Evoke Studios agrees to provide the bride and groom (client) with photographic service for the scheduled event. These services may include a photographer, assistant photographer, prints, negatives, albums, enlargements, frames, USB, movies internet postings, or transmitted digital files, or any combination of the above. Evoke Studios agrees to provide photography services for the time(s) and date(s) indicated in the Service Agreement. 

 

Booking Confirmation

A non-refundable booking fee of $500 is required to reserve your booking. This booking fee is deducted from your package price. Balance of payment is required two weeks prior to the wedding date if full payment is not received the photographer will not shoot the wedding. The payment of this fee books Josie Martin as your photographer in the event that she in not able to attend your wedding due to an emergency situation a replacement photographer will be provided or refund supplied and the client notified. 

 

Limit of Liability

All possible precautions are observed by Evoke Studios to insure the complete and full execution of this agreement as outlined. In the event of mechanical failure, theft, ill health, loss or damage to the images produced, or in the event of the clients’ dissatisfaction with the results produced, namely digital files, prints, internet postings, or any other product or service provided, the limit of liability incurred by Evoke Studios shall not exceed the INITIAL DEPOSITS for the scheduled event. In the unlikely event that a dispute arises, the client and photographer hereby agrees that the choice of venue for settling any such complaint shall be limited to arbitration within the state of Queensland and further any lawsuits filed outside of the state of Queensland shall be considered invalid. Slideshows are a free add on when you book coverage of your reception, however the slideshow will be dependent on the venue and equipment. No refunds will be given if slideshow or video is unable to be completed. Fusion videos are suppled as clips from your wedding day captured at the discretion of the photographer in a way that it doesn’t compromise the photography. Sound or full ceremony, speech is not guaranteed. 

 

Cancellations and Changes

In the event of cancellation by either the bride or the groom, the clients agree to forfeit all deposits made up to and including the date of cancellation. In the event of cancellation by Evoke Studios all refunds will be refunded within 90 days of cancellation. The Photographer shall be held harmless from liability as a result of acts of God, war, natural disasters, or other calamity that may prohibit the execution of this agreement on their part. It is the clients responsibility to notify in writing any changes to times, locations or requirements that are shown on the service agreement. Changes to the agreement must be supplied in writing.

 

Copyright

All images created during this event are the sole copyright property of Evoke Studios and may be used for promotional purposes or any other worthwhile propose without additional consent from the subjects. No images created during the execution of this event may be copied or duplicated in any form without the prior written consent of the Photographer. If your package includes a digital files this license has no expiry date and images and data can be used in anyway the client wishes including but not limited to copy, reproduce, print and publish without watermarks except for commercial profit. 

 

Supplied Services

After booking has been paid for if your package includes an engagement shoot it is the responsibility of the client to book the shoot, the shoot is a bonus get to know you shoot and will be forfeited if not organised before your wedding day. Engagement shoots are not available on Weekends. A proof sitting will be organised 2 weeks after the clients wedding or on return of the honeymoon where the client will view & order the photographs and plan the album; no photos will be available at this time. This session will take about 4 hours and the latest booking time is 4pm. Evoke Photos and albums will be supplied 8-10 weeks after the final approval has been signed. Bookings are to be finalised within 3 months from the date of the wedding or an archive retrieval fee of $100 will be applicable. If your package includes a full resolution disk there will be a minimum of 300 images supplied on this disk images on the USB are not airbrushed, number of images depends on amount of coverage on the day. If shoot time is reduced on the day then number of photos supplied will also be reduced. Photographer has the right to choose the photos that are available for viewing. Fusion video is edited at the discretion of Evoke Studios including music choice. Additional sides in your album edge to edge $125, matted $150 sides in a story book are from $80 and Modern Layflat $100. All prices include GST.

 

The client agrees that Evoke Studios Photographer will be the only photographer on the shoot. The photographer will leave the reception before the sit down but can stay upon prior arrangement, if this is required the photographer is to receive a meal. 2nd Photographer will leave after your entry to your reception. It is at the discretion of the photographer if they are able to photograph in the rain, if it does rain photos will be taken indoors or photographer can return to the location on another day to take photos at no charge however cost of hair make-up and other costs are the responsibility of the client.

 

The Entire Agreement

This agreement is the entire agreement between the parties with respect to the subject matter and no alteration, modification or interpretation hereof shall be binding unless in writing and signed by both parties on the front of this document.
